I always tell my clients, “I guarantee that I’ll complete all my work in under three days, yet, I don’t have a crystal ball.” (Although, that wouldn’t be too shabby!) If I did, I could tell you how long the court will take to complete your divorce.
If the grocery store is busy, you will likely have to wait in line to checkout. The same goes for divorce court.
How long the court takes is out of my hands. Its out of any attorneys hands. How fast you can get divorced depends on numerous factors, such as how many cases they have before yours, if they are under staffed (which they usually are), and whether the court has any issues with your particular paperwork. Hiring a good divorce attorney can help eliminate the last of that list.
If you live in New York City, the court will probably be busier than if you lived in a less densely populated area of New York. This is just common sense.
All in all, your divorce should take on average between 30 and 60 days.
As I have mentioned in previous posts, there are a lot of divorce scam artists that claim they can offer you a Mexican divorce, Nevada divorce, Dominican divorce in no time. Don’t fall for the hype. I am going to go out on a limb here and presume that you want to be sure your divorce is legally binding. If its not, and you remarry you could get into serious legal trouble for bigamy, which is punishable by up to five years of imprisonment in New York. I recommend you play it safe and get a real New York divorce.
