<p>This leads some people to ask for a do-over.</p>
<p>A reader named Phil says he has a friend who went through the process of appealing a divorce judgment, and he is interested in what the process entails.</p>
<p>The first thing someone seeking an appeal will have to do is find a lawyer experienced in the <a href="http://coa.courts.mi.gov/">State Court of Appeals</a> when it comes to divorce – no easy task.</p>
<p>Even some of the best known and experienced family law lawyers don&#8217;t do appeals but instead refer clients to a handful of West Michigan attorneys, including <a href="http://www.btp-law.com/attorney_gtp.html">George Perrett who practices in the Kalamazoo suburb of Parchment.</a></p>

<p><strong>(CNN)</strong> &#8211; David Murphy hasn&#8217;t started shopping for his two boys yet, and he knows he had better get started. The divorced father of two boys, ages 11 and 14, has custody for a full week around Christmas Day this year and needs to get a tree and start buying presents.</p>
<p>Every other year, Murphy (who didn&#8217;t want his real name used to protect his children&#8217;s privacy) doesn&#8217;t have Christmas custody. So, he tries to do something completely different. Divorced for four years, he has traveled with his mother to visit England, where she was born. He has joined his father and stepmother on a trip to Carmel, California.</p>
<p>He hasn&#8217;t crashed his ex-wife&#8217;s Christmas Day plans, even though she lives only three miles away from his home in suburban Virginia.</p>
<p>&#8220;We try not to mess with the schedule when we don&#8217;t have to because it&#8217;s easier on both parties,&#8221; said Murphy. &#8220;As each party has moved on, it happened to work that way. We try not to interfere with each other.&#8221;</p>

Even if you think you have worked out the details months ago, check again to be sure everyone understands where the children will be spending the big event days and under what circumstances. Tell the children in advance about the plans.</p>

Many couples choose divorce based on their current financial situation or the environment around them.</p>
<p>So what should you look out for? <a href="http://www.businessinsider.com/cities-with-the-worst-divorce-rates-2011-7?op=1">New York </a>actually has a lower divorce rates than other states, which experts claim can be partially attributed to the state’s poor economy. With higher taxes and fewer jobs, individual spouses feel less confident on their ability to live and thrive on their own. In addition to paying for the divorce itself, post-divorce you may have to purchase or rent a new house, car, furniture, etc., all of which can be costly.</p>
<p>Connected to a bad economy, an unstable real estate market, can also make getting a divorce more difficult. If you or your spouse is selling your former home, you are likely not going to sell it for your ideal price. A good idea would be to have one spouse stay in the house so you do not have to deal with the market.</p>
<p>Having a bad credit history is not good when you are getting a divorce. Post-divorce, you may find yourself looking for a new place to live, opening a new credit card, or interviewing for a new job. Al of these may be affected if you have a bad credit report. It also can hurt you when settling child custody and financial support arrangements.</p>
<p>Many couples also wait until their children are older to divorce. If you and your spouse choose to divorce with a child under 18, you are going to have to settle custody and financial support. A divorce will affect your ability to pay to support the child and even larger expenses, such as college, may be affected.</p>
<p>If you choose to split up under any of these conditions, pay attention to how those circumstances will affect your life during and after divorce.</p>

We know that today couples are marrying at older ages and dealing with different financial worries and divorce laws. So why has this statistic remained? What makes the seventh year different?</p>
<p>A professor of sociology and public policy at Johns Hopkins University, Andrew J. Cherlin, explains that seven years marks a crucial point in the relationship between spouses. By seven years, a couple has a sense of how they work together, how they sort out problems and whether or not those problems can be fixed. Cherlin stated, “Over time, people’s flaws reveal themselves. The positives remain, but the negatives build up. It may be that after a while you realize your spouse won’t be providing for you economically as well as you want.”</p>
<p>Additionally, while a couple may see reason to split before reaching the seventh year, they may not be emotionally or financially ready to make the decision. Raising kids or trying to move up in the workplace may encourage couples to stay together.</p>
<p>According to the<a href="http://www.health.state.ny.us/nysdoh/vital_statistics/2009/table51.htm"> New York State Department of Health</a>, New York couples also followed this trend. In 2009, more marriages lasted between 5-9 years in both New York City (8,057 divorces) and the state in total (14,700) than any other duration. While New York has seen a recent increase in the divorce rate by 12% due to the enactment of <a href="http://www.huffingtonpost.com/2011/07/28/divorces-in-new-york-state-up-12-percent-since-adoption-of-no-fault-divorce_n_912323.html?ir=New%20York">no-fault divorce</a>, it is still unclear as to how this has affected the median age of marriages.</p>

<p>A recent article by Rome News-Tribune points out that one should not be afraid of getting married again, even if it means walking down the aisle when you are over 40 or 50 years old. You may have an even better sense of who you are and what you are looking for in a relationship.</p>
<p>Newly remarried, Cheryl Huffman, 47, explains her happiness with her husband, Sam, “When you get married when you’re young, everything is new; there’s a lot of pressure, and you change. <p>How long a no fault divorce takes in New York depends on a few factors:</p>
<ol>
<li>Whether you and your spouse are in agreement about getting divorced</li>
<li>Whether your spouse cooperates and signs the divorce papers</li>
<li>How backlogged the court is with divorces at the moment we file the final papers</li>
<li>Whether you choose our Expedited No Fault Divorce Service</li>
</ol>
<p>If you and your spouse agree to get a no fault divorce then that takes care of any procrastinating that can lead to wasted time.</p>
<p>If your spouse signs the documents and gets them back to us quickly, then you will not have to have him or her served and then wait to see if he or she responds.  If we serve your spouse and he or she does nothing we will have to wait the statutory 40 days before going to the court and asking that they grant you your divorce on a default basis.</p>
<p>The court has been receiving more divorce case submissions since the new no fault divorce law became effective in October of 2010.  They are taking longer to review divorce papers and render judgments.  We can not control the court&#8217;s time table, so once we submit the papers we simply have to wait.</p>

<p>My answer is that it depends.</p>
<p><strong>How long an uncontested divorce takes in New York</strong> depends on the following factors, all of which are completely out of our control:</p>
<ol>
<li>How <strong>fast </strong>you get us the information that we need (which we ask on our simple intake form)</li>
<li>Whether your spouse cooperates in the process by <strong>signing </strong>the papers promptly</li>
<li>How backlogged the Court and County Clerk&#8217;s Office is</li>
</ol>
<p>Like I said, all of these factors are completely out of our control.  Right now we are seeing a fast turn around time in New York County, but the downside is that the County Clerk is extremely backed up.</p>
<p>We are getting divorces signed by Judges, but the standard wait time until the judgment gets filed with the County Clerk and becomes public record is eight to twelve weeks.  You are technically divorced, but can&#8217;t run out and get remarried because the divorce is not public record yet.</p>
<p>Anyway the short answer is that we are seeing <strong>uncontested divorces taking</strong> on average two to five months depending on the various factors listed above.</p>

<li>If you initially decide to just mail your soon-to-be-ex-spouse the documents, and he or she doesn&#8217;t comply, how quickly do we have him served (after which we have to wait forty days until we can file for a default judgment)?</li>
<li>How backlogged is the court with matrimonial matters?</li>
</ol>
<p>So when a client asks &#8220;<strong>How long</strong> will this <strong>uncontested divorce process</strong> <strong>take </strong>in <strong>New York</strong>?&#8221; I often silently chuckle because what at first seems like a very simple question has a rather complex answer&#8230;</p>
<p>I wish that I had a crystal ball through which I could predict the exact date we mail you your Certificate of Divorce.  Unfortunately that&#8217;s not reality and is why I have to give a rather broad range of probable lengths of <strong>time </strong>(i.e., two to six months).</p>
