New York Divorce with Assets: Divorce Negotiation and Mediation Your Best Option

If you have marital assets to divide in a divorce I recommend that you attempt to first negotiate, mediate or agree amongst yourselves regarding the division of those assets rather than attempt to litigate.

Many divorce lawyers push their clients towards contested divorce because it makes them money.  I have the opposite approach.  I try to do everything in my power to steer clients away from contested divorce litigation because I know its not always in their best interest.  Often times its the worst approach.

My mantra is “do what’s best for my clientele and they will do right by me.”  It has served me well thus far.  Happy clients refer more clients.

New York divorce negotiation and mediation is often overlooked in our litigious society.  We are taught from a young age to battle things out, that the court is always fair and that justice will be served in a court of law.  Often these things are not true.

New York law gives a tremendous amount of discretion or subjective decision making power to judges when it comes to equitable distribution of assets in divorce.  This translates into unfair and discrepant decisions.

Wouldn’t you like to retain as much control as possible over what happens to your hard-earned assets.  I certainly recommend that you do so.  Through facilitating the negotiation process I often times can help clients obtain far more favorable results than they would have gotten in court.
