Say Goodbye to Fault Grounds New York – No-Fault is Here!

Under the New York divorce law of just last week you would have to allege, plead and prove fault grounds to get a divorce.  This simply means that you had to accuse your spouse of adultery, abandonment, refusing to have sexual relations for over a year, so on and so forth.  Soon, October 14, 2010 to be exact, the new no-fault divorce law will modernize New York’s medieval divorce law.

Although fault grounds were usually not a hot topic of divorce litigation (although they certainly were at times), fault grounds were more of a bar that prevented people from getting divorced.  If you couldn’t prove fault grounds, or your spouse would not agree, then you were stuck in a failed marriage.

Now, as long as you claim that your marriage has “irretrievably” broken down in the last six months, then you can get divorced.  No more jumping through hoops.  No more committing perjury by lying to please the court with fictional fault ground tales.  No more ridiculousness.

Now, if you want out, you can have out.  If your marriage is not working, you can get out.  If you are ready to move on, you can move on.  All thanks to the new no-fault divorce law.
