Social Media Being used as Evidence in Court Proceedings

The increasing popularity of social media has created more evidence to be used in divorce court proceedings. In a recent survey, the American Academy of Matrimonial Lawyers found 81% of attorneys were examining social media Web sites such as Facebook, Foursquare and Twitter to find evidence.

Private Investigator Frank Rudewicz explained that evidence can be found on social media sites because adulterers often forget to use discretion online. “You’re branding yourself like any company would look to brand itself,” he stated, “so you’re putting yourself out there.”

Though no-fault states such as New York cannot penalize adulterers automatically, this evidence can be useful to reveal a spouse’s lifestyle, show whether or not money was spent on an affair and to evaluate a spouse’s credibility, particularly in custody cases.
