With Gay Marraige Comes…Gay Divorce

Governor Andrew Cuomo in only his first year of office, secured a huge victory for Gay Rights yesterday as he signed the bill in place last night to legalize same sex marriage in New York. State senators on Friday voted 33-29 to approve marriage equality legislation purported by the Governor, as New York became the 6th state to legalize gay marriage.

However there is a flip-side to this according to Ruthann Robson, professor of law at the City University of New York “One of the so-called benefits to marriage is actually divorce,” said Robson, “If same-sex marriage is recognized, same-sex divorce would be recognized too.”

Same-sex divorce has actually been recognized in New York since 2008 when an appeals court decided that a same-sex marriage performed in Canada could be legally recognized in New York solely for the purposes of dissolving the union.

However for the past three years, same sex divorce has been handled on a case by case basis, creating room for uncertainty among same sex couples. But now that same sex marriage will be held in the same regard as heterosexual marriage, divorce in turn will now be subject to New York’s Domestic Relations Law, rather being arbitrarily or clumsily based on individual judge or court rulings.
