After The Divorce : Can You and the Children Move out of State?
One of the more testing matters in divorce proceeding is regarding the children. The physiological effect of a divorce on a child can leave scars which last a lifetime. It is an unfortunate situation when children are uprooted from their lives and forced into a new situation. However for many divorcees who want to move on and forget about their past, starting over with their children is a arduous process.
According to Beverly Willett of The Huffington Post: “Courts do permit custodial parents to relocate. But getting the green light can be complicated. Laws vary from state to state, from balancing tests to the “best interests of the child” standards; some states require proof of good faith. Suffice it to say unless your ex and non-custodial spouse blesses your relocation plan, even if it’s only to the adjoining school district, you’ll likely find yourself in a complex, costly legal mess by petitioning to head out of Dodge.”
