Do We Need to Agree Upon Everything to Get a NY No-Fault Divorce?

The new NY no-fault divorce law does not completely change the divorce process, other than whether you will need to plead fault grounds for divorce.  Basically, you no longer have to accuse your spouse of adultery, abandonment or the like to get a divorce.  Now your marriage can just not be working out and you can get divorced.

You will still need to either agree upon or litigate the main issues of divorce: equitable distribution of assets, maintenance or alimony, child support, visitation and custody issues.  The no-fault divorce law does NOT let you now just walk away from the marriage without dealing with all of these issues first.
