How NY Same Sex Law Affects Parenting Agreements

The new same sex marriage law in New York has important implications on same sex parenting agreements. The law will not recognize the non-biological parent as an individual with parental rights unless they finalize an adoption agreement. It is recommended to file for a second-parent adoption in order to gain these parental rights as opposed to simply getting married. This is because some states do not recognize the legal same-sex marriages of other states.
