**NEW** New York State just passed a No-Fault Divorce Law that lets you get divorced without having to accuse your spouse of anything.

Please note that the easiest grounds for divorce to file under are No Fault, Abandonment & Sexual Abandonment. Cruel & Inhuman Treatment and Adultery are hard to prove and cost slightly more to file under. Also, an annulment, publication divorce and civil union dissolution are more work and cost slightly more than an uncontested divorce.

No Fault - Your marriage has become "irretrievably broken" for the last 6 months.

Abandonment - Your spouse left the marital home for over a year.

Sexual Abandonment - Your spouse refused to have sex with you for over a year.

Separation Agreement - You and your spouse have lived separate & apart under a separation agreement that was filed with county clerk. Imprisonment - Your spouse has been imprisoned for the last 3 consecutive years and you were married during that time.

Adultery - Hard to prove because you need a witness who will testify that they personally witnessed the adultery in the past 5 years. Save time & money by selecting No Fault, Abandonment or Sexual Abandonment as a ground for divorce.

Cruel & Inhuman Treatment - Hard to prove because you need to give 3 specific examples of behavior that you endured from your spouse, which made unsafe for you physically or mentally to stay with your spouse. This will add additional time and costs.

Annulment - An annulment is different from a divorce in that it seeks to nullify the marriage and make it like it never happened. The most common basis for an annulment is fraud. For example, if your spouse said that he or she wanted children before marriage but after getting married he or she changed their mind.

Civil Union Dissolution - If you are in a civil union with your partner and not a marriage, you must select this ground to dissolve your civil union.

Publication Divorce - If you do not know where your spouse is located, you're only option is to do a publication divorce. We must first investigate your spouse's whereabouts and if we cannot find him or her, then we file the Publication Divorce.

The Child Support Guidelines suggest that the non-custodial parent pay 17% of their Adjusted Gross Income for 1 child, 25% for 2, 29% for 3 and not less than 35% for 4 or more. You can opt out of the guidelines. The minimum amount per year is $300 regardless of the no. of children.

If your marital assets are in excess of one million dollars, we will need to discuss the fee for the Stipulation of Settlement.
