After No-Fault Law, NY Divorce Filings Are Up 12%

Last fall New York became the last state to approve “no-fault” divorce. Under the old law, a couple had to establish which party was to blame for the split. This determined who received the larger settlement. The new law, however, allows for married couples to get divorce without proving grounds. Instead, if one spouse declares that the marriage has been “irretrievably broken” for at least six months, the couple can be granted a divorce.

Since the law was passed, divorce filings in the state have risen 12% according to state court data. Attorneys expect this law to decrease the number of jury trials, which are the most costly.
